Personal injury is an area of law where a claim or lawsuit is brought on behalf of someone who sustains an injury to the body, mind, or emotions, as opposed to an injury or damage to a person’s property. An injury lawsuit is a civil matter called a tort. This means that there is no incarceration at stake; the lawsuit is about money.

Most commonly a personal injury claim occurs when someone is hurt because of someone else’s negligence. Sometimes the injury can result from an intentional act, such as a physical assault, intentional infliction of emotional distress, or defamation. A person or a company may be found liable for a personal injury, thus requiring them to pay compensatory damages, and in some cases punitive damages. Punitive damages are additional penalties for especially dangerous conduct that shows a conscious disregard for someone’s life or safety.

The term personal injury also includes wrongful death and medical malpractice by doctors and hospitals. Just about any type of injury or death caused by a third party is a potential personal injury lawsuit. Ohio has very strict laws about the timeliness of lawsuits. Most personal injury case lawsuits must be filed within two years if based on negligence. Cases involving medical negligence have a one-year statute of limitations. However, there are catches to all statutes of limitations so you need to see a lawyer as soon as possible after an injury.
